3.1 Conducting Our Business (Performance of the Contract)

We process personal data to establish, perform, or terminate contracts with customers and business partners. The fulfillment of contractual obligations involves various processing activities, such as preparing quotes, processing orders, providing our products and services, offering customer support, and improving our products and services. In doing so, we collect the following data, among others:

  • Master Data: First and Last Name, Salutation and Title, Position and Department
  • Contact Information: (Company) Address, Phone, Fax, Email Address, Website
  • Payment Information: Bank account or credit card information, contact and identification information
  • Contract Information: Customer Number, Contract Relationship, Products and Services Purchased

3.5.1 Accessing the Website

IP addresses are stored anonymously. To do this, the last block of digits is removed; for example, 127.0.0.1 becomes 127.0.0.x. IPv6 addresses are also anonymized. The anonymized IP addresses are retained for 60 days. Information about the directory protection user is anonymized after one day.

This data is processed and stored to ensure a smooth connection and a convenient user experience, as well as to identify malfunctions and for security reasons.

ii. Google AdWords

As part of our website, we use Google AdWords, including conversion tracking. Google AdWords is a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”).

MDESIGN uses reCAPTCHA, an online service of the US company Google LLC, in some online offers. This service distinguishes whether an action (e.g. registration for a seminar offer) is carried out by a person or a computer program. The tool thus serves to protect MDESIGN from spam messages and automated malware. We work with Microsoft Clarity and Microsoft Advertising to track how you use and interact with our website through behavioral metrics, heatmaps and session replay to improve and market our products/services. On this website, you have the option to sign up for our newsletters free of charge to receive regular updates on new products, training opportunities, and events, as well as tips and tricks. To do so, we collect your first and last name, your title, and your email address. The personal data collected in this context is used exclusively for the purpose of sending the newsletter—within the scope of your consent. We use the so-called “double opt-in” procedure for registration. After you register on the website, we will send a message to the email address you provided, asking you to confirm your registration. 3.5.5 Trial Version

On this website, you can request a free trial of MDESIGN . This trial is available either as a download or as a cloud solution via AWS AppStream 2.0. The trial is valid for up to 14 days and begins on the day you install MDESIGN using time-limited licenses or start using the cloud service. When you request a trial, we collect information to identify you. This includes:

  • Company
  • First and Last Name, Title
  • Address (ZIP Code and City)
  • Phone number
  • Email address

This information is used to send you the download link for our trial version and to remind you when the trial period is ending. If the cloud solution mentioned is provided via AWS AppStream 2.0, your first and last name, as well as your email address, will be stored in our AppStream 2.0 account with Amazon Web Services, Inc. as your username. Your email address will also be used to send you the login credentials for this service. Registration for the free trial is voluntary, and you have the option to withdraw your consent at any time.

3.5.6 Registration for Customer and Download Portals

Some of our services require you to register (e.g., MDESIGN Roloff/Matek Edition). The information required for registration is collected during the registration process; this includes, among other things, your first and last name, your title, your email address, and a password. We store the information collected for the purpose of managing your access to the specific product for which you have registered.

The MDESIGN Customer Forum is intended only for customers with a valid service contract. To grant you access to the Customer Forum on our website, we process personal data (customer number and password). You will receive these login credentials by mail after making a purchase at MDESIGN .

 

3.5.7 Purchases

On our website, you have the option to purchase certain products (MDESIGN student). The order is processed through our integrated payment service provider, Verifone. The following information is collected when you purchase these products:

  • Address (Street, House Number, City, Country)
  • Email address
  • Payment Method & Currency

Our website, as well as MDESIGN , contains a large number of links to companies with which we have business relationships. This online offer is not intended for children under the age of 16.

 

4. Legal Basis for Processing

5. Disclosure of Data

Our employees have access to your personal data to the extent necessary to perform their duties on our behalf. In addition, your personal data may be accessed by our partner companies (TEDATA GmbH & DriveConcepts GmbH) so that they can, for example, provide services on our behalf or for customer management purposes. Furthermore, your data may be shared with third parties whom we have commissioned to perform specific tasks. These include, among others, advertising agencies, IT service providers, payment service providers, printing companies, and telecommunications service providers. 6. Online Presence on Social Media

We maintain online presences in social networks and career platforms in order to exchange information with the users registered there and to get in touch with them easily. We regularly publish and share content, offers and product recommendations on our social media presences.

 

6.1 Scope of Processing

With every interaction on our social media presences, the operators of the respective social network automatically collect and store your personal data for market research and advertising purposes. It cannot be ruled out that the data collected may also be processed outside the European Union. Among other things, this can make it more difficult to enforce the rights of the data subjects. Otherwise, the legal basis is Article 6(1)(f) of the GDPR. We have an overriding legitimate interest in optimizing the presentation of our offerings and ensuring effective communication with our customers and prospective customers.

 

6.3 Right of Withdrawal

You have the right to withdraw your consent at any time, without providing a reason, with effect for the future. If you do not consent to the future transfer of your data when using our social media platforms, you have the option to object to the processing of your data:

8. Storage

To the extent that we process and use your personal data for the purpose of initiating, performing, and terminating a contract with you, we will retain your data for as long as required by the statutory retention periods, which are primarily based on civil, commercial, and tax law (AO & HGB).

We use the widespread SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser when you visit our website. As a rule, this is 256-bit encryption.
